On July 8, 2001 a severe thunderstorm moved thru West Melbourne, FL causing significant damage to the Houston Residence. The gutters were blown from the home which in turn pulled the wood supporting the gutters loose allowing water to enter the exterior walls. The insured contacted their insurance carrier and adjuster arrived to assess the damage. The adjuster supplied the insured with an estimate of less than $10,000 in damage, but later informed the insured that no payment would be made. Tutwiler and Associates Inc. was hired to represent the insured and after compiling a comprehensive claim package it was submitted to the insurance company. After lengthy negotiations, a jury trial and a subsequent appeal; total payments in the amount of $817,782.26 were made by the insurance company.
