Hurricane Irma made landfall over southern Florida on September 10th 2017 as a Category 3 storm packing winds of more than 110 miles per hour. It overwhelmed the entire state for nearly two days with heavy rains greater than 2 inches and fierce winds causing extensive damage to a luxury home located on Highland Beach in Palm Beach County, Florida.
The insurance company’s initial offer was well below the Hurricane Deductible of $90,000 resulting in no payment being made to the insured as they felt the damages did not warrant a settlement and further contended damages were pre-existing. The insured’s hired Tutwiler and Associates public adjusters, Rick Tutwiler and Kevin Leisure, to represent them.

Background:
On January 14, 2011 just after celebrating the Christmas holidays, a perilous fire erupted in St. Petersburg, FL causing massive damage throughout the Sheldon family home. Lucky to have survived the fire, the husband and wife team and devoted parents quickly caught their breath and proceeded to make the best out of the situation assuming their insurance company would help them by responding the same. They had no idea that this would turned into a 3 ½ year ordeal that would bring nothing but stress and heartache upon this strong family who lost everything.

On November 29, 2013 a fire broke-out at this 2 story home located in Tampa, FL causing significant fire, water, and smoke damage to the structure and families personal belongings. Immediately after the fire, many different types of vendors offering their services approached the property owner. They included various Emergency Service Contractors and local Public Adjuster “chasers.” At this most vulnerable time, the owners keenly recognized that it was in their best interest to stay away from the majority of these people simply because they did not know who they were and seemed like opportunists. They knew not to sign contracts with any firm until they had a chance to think about it and check references.
