Every year, the insurance lobby tells us insurance companies are losing money, yet lawmakers pass laws and reforms stripping consumers' rights, permitting insurers to delay legitimate claims, and implementing preferred contractor network repair programs that enrich contractors working for insurance companies, rather than insurers indemnifying homeowners for their claims. Additionally, there has not been any real and demonstrative evidence lawmakers can show to support how laws and reforms enacted last year have been protective. All things considered; I am not seeing any financial relief forthcoming for homeowners, especially given the many proposed expansions to the upcoming special legislative session.

So let me see if I have this right. Of course, I have this right! Déjà vu all over again. Within House Bill 305 there is language that not only treads on but stomps on the rights of two business entities which by the way are both licensed and pay fees to two branches of the Florida state government in order to conduct legal and necessary business. Why else would they be issued a license and required to mail fees to Tallahassee if they were not legal and necessary?

This is about the time in the insurance claims settlement cycle that we start getting calls from property owners living in condos, who are looking for help following property damage to their building that impacted their unit. This often takes the form of damage to the unit owner’s property, including their personal property as well as items such as carpet, other types of floor covering, trim items such as door frames, baseboards, cabinets and the list goes on depending on the type and severity of the damage and the wording in their condominium documents. When a covered casualty event occurs, whether it is from wind, water, fire, or the dreaded “mold” word, the finger pointing starts and in many cases the unit owner is caught in the middle.

Hopefully folks in the Mid-Atlantic will survive this storm’s wrath with very minimal loss of life or injury, but even one death or serious injury is one to many. And remember serious injuries and death are not limited to the height of a storm. In fact, state and local officials are warning the communities affected, that rising water, flash flooding, storm debris, downed power lines, and wildlife of all sorts are on the move.

As policyholders begin to hear back from their insurance company, many will learn that the amount offered by their respective insurer is not sufficient to pay for their complete loss and damages. Some may even learn part of their claim is denied. This is common when there is widespread damage to a geographic area and especially true with more complicated commercial claims to businesses, condominiums and hotels where methods to fix or replace damage can become complicated. There can be many reasons for this including overworked adjusters either documenting specific damages or inside claim adjusters denying certain parts of a claim.

The 2016 Windstorm Insurance Conference is in the history books. A final count determined over 1,050 claims professionals were in attendance in Orlando, Florida. Registrations exceeded a lot of folk’s expectations this year given the lack of a major Cat event in the southeast. But this year’s success goes to show that the Windstorm Insurance Network, Inc. has evolved into much more than a regional conference. Super Storm Sandy is a reminder that there are shared experiences with other parts of the country and as the old saying goes, “knowledge and information is power.” The WIND Conference is in my opinion the place to go to enable professionals to enhance their skills and knowledge about property insurance matters.

Over the past few months, we have been helping businesses and homeowners try to settle their insurance claims from the extreme Winter Storm damage that has impacted enough property owners in Massachusetts and throughout the Northeast & New England area that this storm rivals the damage done by other major storms we have worked. As we’ve seen with past major storms with widespread damage, it is very apparent that the insurance company’s are overwhelmed and they are desperately looking for assistance to service all their policyholders who have made claims for their property damage. Similar to hurricanes, the carriers have enlisted the help of many independent adjusters who have made the trip from as far away as Arizona to help them make inspections, write repair estimates, and make field calls before turning their files in and heading back home. The issue with this is that most of these independent adjusters are assigned so many claims that there are simply not enough hours in the day for these adjusters to conduct a thorough inspection of the damage and then spend adequate time behind the computer to write a detailed repair estimate.
