Property Insurance Claim Settlements - The Devil is in the Details

Property Insurance Claim Settlements - The Devil is in the Details
While most folks are enjoying the spring weather and looking forward to summer vacations with outdoor time with the family, others are still working through the insurance claim adjustment process dealing with adjusters and contractors.  Yes, as hard as it may seem, a lot of folks are still struggling with losses over the last twelve months from winter storms in the Northeast, hail and tornados in the Southwest, and Caribbean wind losses from Hurricane Gonzalo.  It’s been a busy season for Public  Adjusters and with their help, many folks are just now entering into settlement discussions with their insurance companies. So now is the time to pay attention to the details in your insurance policy.  The news media seems to move on from storm to storm with little information offered or shared about the vital information you need to know about your property policy and its terms and conditions.

The end of hurricane season 2014 – Why to never let your guard down

The end of hurricane season 2014 – Why to never let your guard down
The end of November brings two significant events. The first is a full court press for the start of the holiday season and the second is the end of the official Atlantic hurricane season. Regarding the former let’s hope it is a good one. Things are looking good as the U.S. stock market continues its upward trajectory and despite reports from the financial sector that 25% of some of the world’s largest economies are in a recession, (some even facing deflation) the U.S. economy continues to grow with the additional good news of little threat of inflation for the homeland. And love those falling fuel prices!

Are October Hurricanes becoming the Norm? Hurricane Gonzalo Update & Business Interruption Insurance Primer

Most in the Caribbean Islands were unprepared.  In fact, one emergency operations manager downplayed the storm over the radio so much that thousands were caught off guard as they did not take the necessary precautions to protect their properties from Hurricane Gonzalo.  It is rumored he will soon lose his job.  At the request of some clients, I flew into St. Maarten the day after the storm passed.

Severe Flood and Wind Damage Claims Pose Equal Threat to Bigger Hurricane Events

Given the severe localized flooding to parts of Southern and the east coast of Florida this past week due to heavy rains, it’s timely to point out that it only takes one storm to trigger a property insurance claim that can decimate your property value. It’s interesting to note a recent article that reviews worldwide property loss stats. While we haven’t had a large catastrophe event it points out that a larger group of smaller storms can still impact insurance rates and property values. Smaller losses, as we have seen in our practice, can still create time consuming claim complications. The time to identify your “claims team” is before you suffer your loss. Work with your insurance agent to fully understand the claims process. Then identify trusted public adjusters, restoration contractors, and yes even property insurance attorneys so you don’t fall upon the predatory few that will try to make a buck from your loss.

Proof of Loss Property Insurance Claim Requirements in Florida

A recent opinion of Florida’s Fourth District Court of Appeals involving a Hurricane Wilma homeowner’s claim has a rather startling decision, and not a good one for the policyholder side. The case Hunt v. State Farm highlights the need for policyholders to pay close attention to their claim, their insurance policy language and any communication they receive from their insurance company. This is particularly true given the results of this case on the requirement to file a proof of loss.

How Emergency Contractors Can Hijack Your Insurance Claim

Action 9 News in Orlando recently did a story about a homeowner who experienced a water loss and quickly hired an emergency contractor who tore out the damaged portion of the kitchen and then kept the insurance proceeds without finishing the job. The conclusion of the report was to strongly recommend that folks that have an insurable loss not sign an all-inclusive right to proceeds contract with a contractor.

Policyholder Question: Condominium Owner Asks About Roof Shingle Replacement Due to Hail

Q. I have a friend that lives in a retirement condominium community. They have a condo policy that covers all 8 buildings in the community. The insurance has paid to replace between 98-160 shingles per roof due to hail damage. The HOA by-laws state that the roof color must be the same on all roofs. After 17 years it will not be possible to match that many shingles on each roof. They have ordinance and law coverage in their policy for replacement cost. Would this apply in this situation? Should the insurance have to pay for a full replacement of the shingle roofs?
