An email from a client down in the Leeward Islands this week prompts me to write this blog.  While Tropical Storm Erika is not forecast to cause a lot of damages to the Windward Island Chain is was clearly a reminder to these folks about last years storm.  Here is what my client had to say: “waited in line at the bank for over an hour, it was packed, the island is in a panic mode because of the 2nd tropical storm that is approaching and especially because of Hurricane Gonzalo last year.”

The end of November brings two significant events. The first is a full court press for the start of the holiday season and the second is the end of the official Atlantic hurricane season. A recent opinion of Florida’s Fourth District Court of Appeals involving a Hurricane Wilma homeowner’s claim has a rather startling decision, and not a good one for the policyholder side. The case Hunt v. Action 9 News in Orlando recently did a story about a homeowner who experienced a water loss and quickly hired an emergency contractor who tore out the damaged portion of the kitchen and then kept the insurance proceeds without finishing the job. Additional Living Expenses Explained for Panhandle Flood Victims

Policyholder Question: Condominium Owner Asks About Roof Shingle Replacement Due to Hail

Q. I have a friend that lives in a retirement condominium community. They have a condo policy that covers all 8 buildings in the community. The insurance has paid to replace between 98-160 shingles per roof due to hail damage. The HOA by-laws state that the roof color must be the same on all roofs. After 17 years it will not be possible to match that many shingles on each roof. They have ordinance and law coverage in their policy for replacement cost. Would this apply in this situation? Should the insurance have to pay for a full replacement of the shingle roofs?
