Florida’s Property Insurance Policyholder – Still in Crisis

Florida’s Property Insurance Policyholder – Still in Crisis

With yet another Special Session beginning this week and a new legislative session beginning in March, Florida Legislators will soon be faced with some unexpected consequences, from new changes to the state’s insurance laws, that were passed by the Florida Legislature in May and December along with other pro-insurance reforms. There’s also, more work that needs to be done.

Insurance Carriers Create Policyholder Recovery Issues with Poor Claims Practices

Let’s hope the FL legislators take a hard look at the sloppy claims practices and delay tactics that are hindering Hurricane Ian recovery during the special session on insurance reform next week. Insurance carriers and their claims departments should be put under the same scrutiny as Public Adjusters and Attorneys. Maybe if the carriers start getting fined they will treat their policyholders more fairly rather than trying to save a buck. Unfortunately, this is not an isolated case based on our experience. https://www.abcactionnews.com/news/state/hurricane-ian-victims-struggling-with-insurance-claim-payouts-seek-help-from-public-adjusters

Public Adjusters are Part of the Solution to Hurricane Ian Recovery

Public Adjusters are Part of the Solution to Hurricane Ian Recovery
A recent open letter from the National Association of Public Insurance Adjusters (NAPIA) stated: "Public insurance adjusters are experts in the claims adjustment process and are, along with attorneys, the only “licensed” profession that can help consumers by preparing, filing, and adjusting insurance claims. It is important to note that policyholders have the right to hire their own adjuster to assist them with the preparation of their claim.” In Florida, there are currently over 2,700 licensed and bonded Public Adjusters listed on the Department of Financial Services license search website. Not only are public adjusters already highly regulated by the state, but the national (NAPIA) and state (FAPIA) industry associations impose a high ethical standard on members. During Hurricane Michael and other storms, public adjusters were there to help policyholders when their insurance companies did not have the resources to respond in a timely manner.

Florida Property Insurance Reform – Who is This Session For?

Florida Property Insurance Reform – Who is This Session For?

While it’s troubling to watch FL residents suffer soaring rate increases, I’m still hoping some meaningful legislation will be passed that will “immediately” impact rates and help property holders. The frustrating part is the partisan politicians who turn a blind eye when good amendments are put forward that could easily provide some rate relief. Just watch the consumer-friendly amendments laid out by Senator Gary Farmer who very eloquently explains the insurance shell game.

Florida Legislators Must Be Mindful Fixing the Homeowners’ Insurance Crisis - Don't Throw the Baby Out with the Bathwater

Florida Legislators Must Be Mindful Fixing the Homeowners’ Insurance Crisis - Don't Throw the Baby Out with the Bathwater

Every year, the insurance lobby tells us insurance companies are losing money, yet lawmakers pass laws and reforms stripping consumers' rights, permitting insurers to delay legitimate claims, and implementing preferred contractor network repair programs that enrich contractors working for insurance companies, rather than insurers indemnifying homeowners for their claims. Additionally, there has not been any real and demonstrative evidence lawmakers can show to support how laws and reforms enacted last year have been protective. All things considered; I am not seeing any financial relief forthcoming for homeowners, especially given the many proposed expansions to the upcoming special legislative session.

Windstorm Insurance Network 2022 Conference Recap

Windstorm Insurance Network 2022 Conference Recap

WIND held its annual 2022 conference at the Lowes Royal Pacific Resort at Universal Orlando at the end of January.  I have to say that I was a little hesitant attending this conference as it is a multi-day event held in a venue which is a closed environment inside of a very large resort. Based on past year’s attendance I would have expected well over 1000 insurance professionals, experts and vendors showing up to network, learn best practices and refresh their knowledge. To my surprise despite the virus threat, over 1000 people did in fact register and that didn’t include late walk ins, who decided they did not want to be behind the learning curve.  For me, besides seeing old friends and meeting new people from various disciplines, the highlight of the conference was the keynote speaker presentation.

Champlain Towers Collapse – A Public Adjuster’s View

Champlain Towers Collapse – A Public Adjuster’s View

As the Champlain Tower collapse unfolds, people must understand this is a very fluid situation. Now is not the time to be pointing fingers but instead supporting the victims' families and conducting a thorough and objective investigation. That being said, as a 45-year veteran of insurance adjusting in Florida, I have seen and been involved in all types of condo claims in Florida for decades. I concur, water is the cause or should I say the most frequent cause of all insurance losses. Water damage has and still is occurring and causing failures of building components particularly in ocean side concrete structures.
